Welcome to my commissions page and online portfolio website! As an artist I provide services to you / clients which are subject to the following conditions. If you reach out to me for work or begin the process of commissioning me you are agreeing to the following terms of service and conditions.

-- Privacy Policy --

As an artist and creator I understand the importance of privacy, protection and comfort. As an artist I often post finished commission work, along with progress for said work in picture and video format, as well as possibly live streaming the process, on websites such as YouTube, Twitch, BlueSky, etc. If you are uncomfortable with me sharing the final work I create for you, or any works in progress for your piece, or you would simply prefer for the results and process to remain private please ensure you clearly state this to me whilst reaching out at the start of the process, to avoid any complications or issues and so I can remain respectful of your boundaries.

Below are the terms and conditions you acknowledge when beginning a commission with, Katherine Harris, who will be referred to in the following document as Kat_Astrophew​.

Please read them carefully before agreeing / contacting Kat_Astrophew with possible commission work, when contacting them you are agreeing to the following terms and conditions and they will assume as such unless otherwise stated to them.

1. Artists Rights - The artist, Kat_Astrophew, reserves the right to refuse service and deny a commission to anyone, without need to provide reason

2. Payment Options - Payment for the commission can be made through two options :

2.1 - Full Upfront - With this method you the client will be paying the full commission price upfront. This method will put your commission on the high priority list*

2.2 - 50% Upfront - With this method you the client will be paying 50% of the commission price upfront, with the other half to be completed upon finishing the final sketch*

2.3 - Full at Finished Sketch - With this method you the client will be paying the full commission price upon the completion of the final sketch*

2.4 - 50% at Finished Sketch - With this method you the client will be paying 50% of the commission price upon the completion of the final sketch* with the following 50% to be paid when ready

3. Payment Requirements - For protection the artist, Kat_Astrophew, will not continue the commission past the sketch phase UNTIL the full price has been paid for the product. Until the price has been paid your commission will be put on the hold list* to be continued on payments completion

4. No Refunds - Due to the nature of the product produced by Kat_Astrophew there are no offered refunds or returns. No refund will be offered at any point of the process, with no exceptions

5. Adjustment Limit - There will be certain limitations to how many adjustments can be made and when in the process of a commission, this is to protect the artists worker rights and prevent exploitation. More details can be seen in the following section : 

5.1 - Major Changes / Adjustments during Sketch Phase - During the sketch phase you will have a limit of 5 major changes and adjustments* to the piece

5.2 - Major Changes / Adjustments after Sketch Phase - After the sketch phase is complete you will be unable to make any major changes or adjustments* to the piece

5.3 - Minor Changes / Adjustments before Final Render Phase* - Prior to the final rendering phase* you can request any minor changes or adjustments* to the piece

5.4 - Minor Changes / Adjustments after Final Render Phase* - After the final rendering phase* has begun you will only be allowed 5 minor changes / adjustments* to the piece

6. Protection against Generative AI - As an artist the use and practice of AI has been used to damage myself, others in the community as well as the creative industry as a whole and as such AI will not be accepted or allowed in any part of the commission process, before OR after the commissions completion. This includes the following terms :

6.1 - The work produced by Kat_Astrophew for the client will not be used in AI training or programming

6.2 - The client will not use references or works derived from AI for references to be used by Kat_Astrophew, to the best of their ability

6.3 - If a client is found using Kat_Astrophew's work in an AI process or AI in any capacity they will be placed on a Blacklist, and will be refused service by Kat_Astrophew going forward

6.4 - You acknowledge that the final piece provided may have a Nightshade version which can be posted, to help prevent Kat_Astrophew's work being used by AI as well as to poison current AI models. This is used as a safety measure and is NOT encouraging clients or others to upload final work onto AI systems, see 6.3 for repercussions

7 - Protection against NFTs or Crypto - As an artist Kat_Astrophew is against NFTs and Crypto Currency, for personal reasons. With this understood and agreed the client, you, will not use the final product provided in the creation or use of NFTs or Crypto Currency. Ignoring this term will result in your placement on a Blacklist, refused service by Kat_Astrophew as well as possible legal ramifications

8 - Reference Requirements - For commission work Kat_Astrophew will require a minimum or five pieces of reference material for the piece. This is to help get the highest quality result for the commission. This reference material can range from other digital art, photographs, personal photos or highly detailed descriptions*

9 - Credit when Posting - Please ensure proper crediting when posting the final commission or any works in progress to social media. To do this please mention the artists handle, @Kat_Astrophew​, along with a link to their carrd : https://kat-astrophew.carrd.co/

Terms in this document :

1* Priority List - Those who pay early OR are under specific circumstances will be placed on the Priority List. This list indicates that your commission should be worked on first/more quickly than others in the primary list​

2* Final Sketch - Kat_Astrophew will indicate to you via your chosen communication method, when they are finishing the sketch. Once you have made any final adjustments, the piece will be classified as the final sketch

3* Hold List - Those who are still in the process of paying for their commission will be placed on the Hold list. This list indicated that your commission has been paused/put on hold. The work will be continued when the agreed upon requirements have been met by the client

4* Major Changes / Adjustments - Major changes / adjustments to a piece are classified by the amount of time and resources used in their process. Some examples which would be classified as major changes / adjustments are :

- Changing the pose a character is in

- Changing a characters body type

- Changing the background of a piece

- Changing the facial expression of a character

- Changing an entire outfit for a character

- Making alterations to the colour scheme of the overall piece

- If you are unsure on how large a change is please ask Kat_Astrophew through your preferred communication method e.g. Email, Instagram, Discord , etc.

5* Minor Changes / Adjustments - Minor changes / adjustments to a piece are classified by the amount of time and resources used in their process. Some examples which would be classified as minor changes / adjustments are : 

- Changing individual articles of clothing (e.g. shirt, trousers, dress etc.) or adding accessories

- Minor changes to pose or anatomy, e.g. hand poses, adding scars or other details

- Changing smaller sections of colour, on the character or background

- Adding small detail work to the piece, e.g. birds flying in the background, adding patterns etc.

- If you are unsure on how large a change is please ask Kat_Astrophew through your preferred communication method e.g. Email, Instagram, Discord , etc.

6* Final Render Phase - Kat_Astrophew will indicate to you via your chosen communication method, when they are starting the final render. Once you have made any final adjustments, the piece will be classified as being in the final stage/the final render phase

7* Highly Detailed Descriptions - An example of a highly detailed description can be seen below :

- [Character] will be sat relaxed at a bar holding a glass of wine gracefully, a light is shining down on the character from above. The camera will be at a slight lean looking up at her, I've provided an example of the angle I was thinking [picture reference of angle] . The bar resembles old western / pirate bars with nautical touches, such as a boats steering wheel or fishing nets hung up as decoration. Bottles of alchohol are behind her on shelves. Here is an example of the kind of colours I like /  wanted included for the piece [picture reference of colour scheme]
